At Open Music Networks Inc. (“Openmusic,” “we,” or “us”), we are committed to protecting your privacy and keeping your information safe. Openmusic processes information about you in a few different ways. This Privacy Policy explains how we collect, use, disclose, and keep information that can identify you (“Personal Information”) when you create an Openmusic account and use openmusic.io (the “Site”) to post content to the Openmusic community, including music you create, comments, and messages (the “Services”).
We are subject to the Personal Information Protection and Electronic Documents Act (“PIPEDA”) and applicable provincial privacy legislation. This Privacy Policy describes how we meet our obligations under those laws.
Note that our Terms of Use apply to this Privacy Policy. By creating an account with Openmusic, using the Services, or submitting any Personal Information via the Services, you are consenting to the collection, use, and disclosure of your Personal Information as described below in this Privacy Policy. If you do not consent to the use of your Personal Information in these ways, please stop using the Services.
The Services are not directed to individuals under the age of 16. If you are under 16, please do not create an account or use the Services.
What is Personal Information?
“Personal Information” is any information that can identify you. This may include, but is not limited to, your name, mailing address, telephone number, email address, Internet Protocol (“IP”) address, and age.
What We Collect
- In order for you to create an account with Openmusic and use our Services, we need to collect and process some Personal Information. Information that is necessary for the use of our Services includes: your name, email address, and a password.
- Information you may choose to give to us, such as your profile description and location.
- Information we automatically collect from your use of our Services, including:
- IP address
- Cookie data
- Device information
- Browser type
- Operating system
- Pages visited
- Actions performed (e.g., projects created)
How We Use Your Personal Information
We use this Personal Information to:
- Identify you across the Services (e.g., when you sign in, create a project, or make a comment)
- Provide you with technical support services
- Communicate with you (e.g., letting you know about upcoming changes or improvements)
- Display the information as part of your Openmusic profile
- Calculate anonymous, aggregate statistics to better understand our users, improve our Services, and develop new features
- Personalize and customize your Openmusic experience
- Measure your use and overall satisfaction with our Services
- Investigate and prevent reported issues, illegal activity, and breaches of our Terms of Use
- Help prevent spam, fraud, abuse, and other prohibited activity
We treat the Personal Information above as private by default, so it won’t be displayed on the Site (unless you choose to publicly display applicable information via your account profile), revealed to other Openmusic users, or rented or sold to anyone.
If you are a parent or guardian and learn that your child under the age of 16 has provided us with Personal Information without your consent, please contact us at privacy@openmusic.io.
What Can Other Openmusic Users See?
Our Services are designed to help you share information with the Openmusic community. Any Personal Information that you voluntarily choose to include in a publicly accessible area of the Service will be available to anyone who has access to that content (including other Openmusic users), such as your name, the profile description you create, your location, content you upload, as well as the messages you post and other information that results from your use of the Services.
We may use this information to make inferences, such as what content or projects you might be interested in, so that we may assist in introducing potential collaborators. Our default is almost always to make the information you provide through Openmusic public to the rest of the Openmusic community, but we also offer features, such as direct messages and private invitations to projects, to make the information more private, if you want.
Third Parties
We may share your Personal Information with third-party service providers, but only where it is necessary to provide the Services to you. Our current third-party service providers include:
- Clerk — authentication and account management
- Microsoft Azure — cloud infrastructure and file storage
- SendGrid — transactional email delivery
- KickoffLabs — waitlist and signup management
When we share data with third-party services that support our delivery of the Services, we require that they protect your Personal Information to the same standards we do.
We do not and will not sell, rent, or share your Personal Information for advertising purposes. We will only disclose your Personal Information in the following limited situations:
- To comply with an applicable law (including investigations of any crime), regulation, legal process, or enforceable governmental request
- To enforce or apply our Terms of Use and other policies, including investigation of potential violations
- To protect the rights, property, or safety of Openmusic, our employees, our users, or the public
- If Openmusic is involved in a merger, acquisition, or asset sale, in which case we will continue to ensure the confidentiality of any Personal Information and give affected users notice before Personal Information is transferred or becomes subject to a different privacy policy
Where Do We Store Your Personal Information?
Our Services are provided from Canada. Your Personal Information may be transferred to, processed, or stored in jurisdictions outside of Canada, including countries where our third-party service providers operate. The privacy laws in those jurisdictions may differ from those in your jurisdiction of residence, and your Personal Information may be accessible to law enforcement and government authorities in accordance with the laws of those jurisdictions.
By using any of the Services, or submitting any Personal Information via the Services, you authorize Openmusic and its authorized service providers to process your Personal Information in such jurisdictions. We require that our service providers protect your Personal Information to standards comparable to those described in this Privacy Policy.
Access to Your Personal Information
If you wish to access any Personal Information that we hold about you, or request that we correct or delete the Personal Information that we hold about you, you may contact us via email at privacy@openmusic.io. We will comply with such requests to the extent required by law or our policies, and subject to any limitations in our systems.
To access, modify, or delete the Personal Information you have provided to us, please log in and update your profile and/or account settings.
How Does Openmusic Protect My Personal Information?
We are continuously implementing and updating physical, organizational, contractual, and technological security measures to protect your Personal Information from loss, theft, unauthorized access, disclosure, copying, use, or modification. The only employees who are granted access to your Personal Information are those with a business “need-to-know” or whose duties reasonably require such information. On all Openmusic platforms, we support encryption on all transmissions to protect Personal Information submitted on our Site.
Data Breach Notification
In the event of a breach of security safeguards involving your Personal Information that creates a real risk of significant harm to you, we will notify you and the Office of the Privacy Commissioner of Canada as required under PIPEDA.
What Happens to Your Personal Information When You Leave Openmusic?
If you close your account, it will first be deactivated for a period of six months. When your account is deactivated, while it is not viewable on Openmusic, all of your public contributions and comments to the Openmusic community will remain.
For six months after deactivation, it is still possible to restore your account if it was accidentally or wrongfully deactivated. After six months, we permanently delete your Personal Information (including your name, email address, and profile data) from our systems, except that your public comments and any content you have uploaded but not deleted will remain on the Service in de-identified form.
Content that you contributed to collaborative projects will remain available to other users after account deletion. Contributor credits associated with your contributions will be retained as rights management records to satisfy attribution obligations under the applicable Creative Commons license. These credits are maintained separately from your Personal Information and are not deleted as part of account closure.
Cookies
Openmusic uses cookies on our Service to support essential platform functions. Cookies allow us to maintain your session, remember your preferences, and provide the Service to you. The cookies we use are:
- Session cookies set by our authentication provider (Clerk) to keep you signed in
- Essential platform cookies necessary for the Service to function
We do not use cookies for advertising or third-party tracking purposes. You may configure your browser to refuse cookies, but doing so may prevent you from using some features of the Service.
Changes
Our Privacy Policy may change from time to time. We will not reduce your rights under this Privacy Policy without your explicit consent. In other cases, please note that your continued use of the Services after any change means that you agree with, and consent to be bound by, the revised Privacy Policy. If you disagree with any changes in this Privacy Policy and do not wish your Personal Information to be subject to the revised Policy, you will need to close your account and/or stop using the Services.
Governing Law
This Privacy Policy shall be governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein.
